DNA test sentences man to 10 years in prison for raping his underage daughter; 2 released | Nagpur News

Nagpur: District and Extra Sessions Judge SM Ali on Monday sentenced a man in his 40s to 10 years rigorous imprisonment and a fine of 10,000 rupees after convicting him of raping his underage daughter 14 years old. The girl had given birth to a baby in 2017.
A DNA test had established the paternity of the father, after the girl refused to reveal the baby’s father. The test also led to the acquittal of two other defendants. The rape survivor was the daughter of his first wife’s rapist.
The court convicted the man under the provisions of section 376 and its subclauses of the Indian Penal Code as well as the Protection of Children from Sexual Offenses Act 2012.
It was learned that the survivor named two neighbors as the perpetrators and that they were arrested in the case, which rose to prominence after the minor was diagnosed five months pregnant. She had subsequently given birth to a baby as well.
The minor named her father the rapist after the baby’s DNA test failed to match samples from the two previous defendants. After his father’s DNA test correspondence, he was taken into custody by the Pachpaoli police who had registered the case in July 2017. The case was investigated by the sub-inspector. from the time of the Pachpaoli police station, Mangala Mokashe.
Additional prosecutor Asavari Parsodkar said 14 witnesses had been interviewed, but the testimony of the minor victim and chemical analysts were crucial to the conviction.
The case had already been handled by the additional PP Rashmi Khaparde.
